US solar tariffs challenged by Canada


July 24 (Solar) – Canada has requested a NAFTA Chapter 20 review of the safeguard tariffs imposed by the US on imports of solar photovoltaic (PV) cells and modules, it was announced on Monday.

The Canadian government believes these measures are “unfair and illegal”. It points out that the International Trade Commission's (ITC) investigation found no significant harm for US manufacturers from Canadian products and the US ITC did not recommend tariffs on Canada. Still, it was included in the list of countries facing the 30% solar tariff which has “affected businesses and workers on both sides of the border”, Canada’s Minister of Foreign Affairs Chrystia Freeland said.

Canada said the duties violate North American Free Trade Agreement (NAFTA) rules.

“Canada’s innovative solar industry supports businesses and workers in the clean-technology sector which is vital to our economic prosperity,” the government said.

In February, soon after the US approved the safeguard tariff, it was reported that Canadian Solar Solutions Inc, Canadian Solar (USA) Inc, Silfab Solar Inc and Heliene Inc have started a legal battle against the measures.
